Evertek Customer Terms Agreement

PLEASE READ THIS DOCUMENT CAREFULLY. This is a legal agreement between you and Evertek Computer Corp. BY JOINING, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT

This Agreement sets out the terms on which Evertek offers its products and services.

CONDITIONS

No Price Protection or Stock Rotation:

Evertek does not offer any type of price protection or stock rotation. We often lower prices suddenly and without notice.

We make every effort to provide information that is as accurate as possible. However, as all specifications and descriptions are provided by the supplier of the product, we make no warranties, express or implied, as to the accuracy of any information, including price, descriptions, specifications and/or quantities. Both Both product and manufacturer name are for identification purposes only. Images are representative only. Actual unit packaging may vary.

Minimum order size:

We sell wholesale ONLY. Minimum order is $100.00. Orders under $100.00 will incur a $10.00 surcharge.(International orders require a minimum of $1,000)

Domestic Sales Terms:

New domestic accounts are normally set up on credit card terms (we accept Visa, MasterCard or American Express). For existing COD customers, we use a check guarantee service for all COD shipments of company checks. If we are unable to obtain approval for your company check order, you have the option of paying by Visa/Master Card/American Express or cash on delivery cashier's check. Orders over $10,000 must be sent by wire transfer be paid in advance.

Company checks:

We cannot accept personal checks. The address printed on your company check must match the shipping address.

Late Fees:

Evertek charges late payment interest (unpaid invoices for any reason) at the rate of 2% for the first 30 days overdue, then 5% each month. We reserve the right to waive the fee at our sole discretion.

International Conditions of Sale:

International sales are on a prepaid bank transfer basis only. We do not accept credit cards or letters of credit L/C's.

NSF Policy:

Any returned check disqualifies the account from all future corporate check privileges and may be subject to treble damages, service fees, collection fees, and attorneys' fees.

Credit Cards: (US accounts only)

We ONLY accept Visa, Master Card or American Express! All credit card sales must be sent to the credit card billing address.

Prices:

All prices are ex warehouse in Temecula, California, USA.

Obsolete Disclaimer:

Evertek buys, repairs, and sells refurbished goods. We are not authorized by Apple or any major manufacturer to make repairs. SOP is to replace parts on similar systems, however, occasionally third party parts may be used to make repairs, in addition the units purchased from us for resale will contain the same. When selling non-factory refurbished Evertek products, please state clearly that these units are refurbished and may contain third party parts.

International payment terms:

Payment terms for international sales are prepayment via wire transfer, US dollars only. We do not accept international credit card payments or Letters of Credit (L/Cs). Customer is responsible for all fees deducted from wire transfer payments, including shipping and intermediary bank fees .Please indicate "No Beneficiary Fees" in the "Reference" section or other appropriate section of your transfer note. Customer is also responsible for underpayments resulting from currency conversion fluctuations. Prior to shipment, Evertek will notify customers of any changes in the Notify orders that are required due to underpayments received.

International shipments:

International customers are responsible for determining their country's duties, tariffs or taxes. For international shipments over 450kg, we can provide prepaid freight quotes for major airports on a "door to airport" basis.

Truck shipments:

If no other shipping method is specified, Evertek will ship via the cheapest qualified carrier available. If this is an issue, be sure to specify how you would like an order shipped. (We only use reputable national carriers). Although you have the option of your To insure truck shipments (common carriers such as Yellow Freight, Roadway, etc.), it is STRONGLY recommended to purchase separate inbound insurance. Shipments for computer products are classified as 92.5 inch tariff and trucking companies have a limited liability of 5, $00 per pound if a crate is lost or damaged. This means that if a 30lb. crate of (10) hard drives is lost (worth $80.00 each, the crate is worth $800), the claim would only pay out $5.00 x 30 pounds = $150.00. For this reason, we strongly recommend that you purchase insurance that will cover you for such situations.

You pay shipping costs:

When you place an order, after you reach the last confirmation page, we will immediately send you a confirmation of your order by e-mail. If you find any errors, please contact us immediately. Freight charges may be blank on the confirmation Once the freight cost has been calculated and the order shipped, we will email you again with the shipping cost and tracking numbers.

Rejected shipments:

If a shipment is refused for any reason, the customer is responsible for the freight charges incurred. Evertek also reserves the right to charge a 20% restocking fee (which we may waive).

Direct Manufacturer Guarantees:

If there is a manufacturer warranty, you must return the device directly to the manufacturer unless the device was DOA (within 7 days of receipt).

Warranty Limitations:

Evertek cannot guarantee items that have been misused or physically damaged.

RMA's:

RMA numbers are valid for 14 days after issuance.Once you have received an RMA number, please return the items immediately.

expediency:

Evertek cannot guarantee that any product will be fit for any particular use or purpose. We strongly encourage customers to evaluate a sample unit to determine, based on their criteria, whether a product will work in their configuration. There are many in the computing world Products that are incompatible with a specific brand or parts. In such cases it is your responsibility to resell the product to a standard application in which the part will work. We cannot take parts back as they will not work on a specific branded product , if they work properly in others.

Defective products:

Any damage resulting from a defective product is limited to a refund of the purchase price. Defective items will be replaced with either a repaired or refurbished unit (including for DOAs). If a replacement unit is not available within 30 days, we will issue a credit. Credits expire 6 months from the date of issue. A credit can be refunded if it has not been used on an order for 30 days. Refunds will be made to the original payment method used for the purchase. RMA credits are for the product only and include NONE Shipping cost refund.

All sales are final:

All sales are final. Any product returned, except with defects, will be subject to a 20% restocking fee. No returns will be accepted after 14 days of receipt.

48 hour grace period for returns:

Returns are permitted, but only within the first 48 hours of receipt for orders that do not meet your expectations. Returns after this period are at Evertek's sole discretion and will incur a significant restocking fee.

Damaged items or missing parts:

Damaged items or missing parts/accessories not as advertised must be reported within 7 business days of product receipt.

Warranty Repair:

All items returned for warranty repair must be poorly tested prior to returning the part. We will charge a service fee if we find a returned item in working condition.

Returning defective items:

Customer MUST CAREFULLY PACK defective items being returned as if new and working, with ALL parts and accessories originally included. Failure to do so may void both the RMA and warranty.

LIMITED WARRANTY:

Some items may have a limited warranty. Please check our sales records and your invoice to ensure the warranty is as expected.
